SOCIAL CLUB PHOTOBOOTH
Terms of Conditions of Hire

These Terms & Conditions form the agreement between Social Club Photobooth (ABN 49 923 242 911) (“Social Club Photobooth”, “we”, “us”, “our”) and the person or organisation making the booking (“the Client”, “you”). By paying the deposit and/or signing below, you confirm that you have read, understood and agree to these Terms.
1. Definitions
1.1 “Booth” means the photo booth and/or any other booth or service supplied by Social Club Photobooth, together with all equipment, props, backdrops and software provided.
1.2 “Services” means the Booth hire and any add-ons booked by the Client (for example additional prints, guest books, backdrops, idle time or extended hire).
1.3 “Event Date” means the date on which the Services are provided.
1.4 “Venue” means the location of the event as advised by the Client.
1.5 “Hire Period” means the agreed period during which the Booth is available for guests to use. Setup and pack-down occur outside the Hire Period.
2. Booking, Payment & Cancellation
2.1 Deposit. A non-refundable deposit of $300 is required to secure your Event Date. The deposit forms part of your total fee and reflects our costs in reserving the date and turning away other enquiries.
2.2 Confirmation. Your booking is confirmed once the deposit has cleared and we have issued a confirmation email. Remittance advice or proof of payment may be requested, and a receipt will be issued once funds clear.
2.3 Balance. The remaining balance is due no later than 21 days (3 weeks) before the Event Date. For bookings made within 21 days of the Event Date, full payment is required within 24 hours of booking, or by the date we specify in writing.
2.4 Late payment. If payment is not received by the due date, a late fee of $15 per day may apply until the balance is cleared, and we reserve the right to cancel the booking if the balance remains unpaid by the agreed due date.
2.5 GST. All prices are inclusive of GST unless otherwise stated. A valid tax invoice will be provided on request.
2.6 Public holidays & peak dates. Bookings on a gazetted public holiday, or during the period 24 December to 2 January, incur a 15% surcharge. Any applicable surcharge will be shown in your quote and confirmed before you pay.
2.7 Cancellations by the Client must be made in writing by email. The following applies:
The $300 deposit is non-refundable on any cancellation. If you cancel before the balance is due, the deposit is the only amount retained.
Cancellations made more than 10 days before the Event Date: any balance already paid is held as a credit, valid for use within 12 months of the original Event Date.
Cancellations made within 10 days of the Event Date: payments made are non-refundable, as we are unlikely to be able to re-book the date at short notice.
If we are able to successfully re-book your Event Date to another client, any balance you have paid (excluding the deposit) will be refunded or credited to you.
2.8 Postponements. Requests to postpone must be made in writing. We will do our best to transfer your
booking to a new date subject to availability; the deposit and any payments carry across to the new date.
3. Hire Period, Setup & Delays
3.1 The Hire Period begins and ends at the times set out in your booking confirmation. Setup and pack-down occur outside of, and do not reduce, the Hire Period.
3.2 Our team typically arrives approximately 90 minutes before the Hire Period to set up. The Client is responsible for ensuring appropriate access and space is available at that time.
3.3 Delays caused by Social Club Photobooth will result in an extended finishing time so that the full Hire Period is delivered. Delays caused by the Venue or the Client’s actions (including late access) will not extend the agreed Hire Period.
3.4 If the event runs overtime, additional hire time may be provided at a rate of $100 per hour, subject to availability and our staff’s agreement on the day.
4. Idle Time & Overtime
4.1 We can often arrange an earlier setup at no extra cost, depending on venue access and scheduling. However, if you require the Booth to be set up more than one hour before the Hire Period begins, or packed down later than agreed, an idle fee of $100 per hour may apply.
4.2 Any idle or overtime fees will always be quoted and agreed with you before payment is requested. We will never apply an idle or overtime charge as a surprise.
5. Venue, Access & Requirements
5.1 The Client is responsible for providing the correct Venue address and access details. We are not liable for delays caused by incorrect or incomplete address details.
5.2 We require a minimum flat, level space of 3m x 3m with at least 3m height clearance, preferably indoors and undercover.
5.3 Access to a dedicated 10-amp power outlet (GPO) is essential and must be available within 5 metres of the setup location.
5.4 For safety reasons, our backdrop must be positioned against a wall to prevent guests from accidentally falling behind it and injuring themselves.
5.5 The Client must provide a Venue contact to arrange access at the agreed setup time, and allow sufficient time for setup and pack-down.
5.6 Suitable parking must be available at or near the Venue for loading and unloading. Where parking fees exceed $50, the Client is responsible for those costs.
5.7 Outdoor events. Outdoor setups must be approved in advance and require a flat, dry surface with full overhead protection (for example a marquee). We reserve the right to cease operating if weather (rain, wind or extreme heat) poses a risk to equipment or safety; it is the Client’s responsibility to have a suitable backup location.
6. Equipment Use, Conduct & Damage
6.1 The Client must provide a safe environment for our equipment and staff at all times.
6.2 We reserve the right to deny service or restrict access to the Booth, without refund, where the safety of equipment, staff or guests is compromised — including as a result of excessive intoxication, misuse of equipment, or unsupervised use by children under 12.
6.3 The Client is responsible for ensuring children under 12 are supervised while using the Booth.
6.4 For safety and proper functioning, no food, beverages, cigarettes or e-cigarettes are permitted on or near the Booth, particularly near the printer.
6.5 Props are provided for guest enjoyment and must be treated with care and returned in their original condition. The Client is responsible for any damage caused by guests to the Booth, props or equipment (excluding ordinary wear and tear), and reasonable repair or replacement costs may apply.
6.6 If service is paused or ended due to inappropriate conduct or misuse, no refund will be issued for unused Hire Period.
7. Liability, Insurance & Image Consent
7.1 Insurance. Social Club Photobooth holds $20 million in public liability insurance and maintains workers’ compensation insurance. A certificate of currency can be provided on request.
7.2 Limitation of liability. To the maximum extent permitted by law, our total liability under or in connection with this agreement is limited to the total amount paid by the Client for the Services. We are not liable for indirect or consequential loss, including loss of profits or emotional distress.
7.3 Personal property & injury. We do not accept liability for loss of or damage to personal belongings, or for injury, except to the extent caused by our proven negligence.
7.4 Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability for breach of such a guarantee cannot be excluded but can be limited, our liability is limited (at our option) to re-supplying the services or paying the cost of having them re-supplied.
7.5 Image consent. Unless you request otherwise in writing before the event, you grant us permission to use selected photos and videos from the event for marketing and promotional purposes, including on our website and social media. We will not use any image or material we consider unsuitable, or that we feel may be damaging to any person. If you or a guest wish to have a specific image removed, notify us by email and we will make reasonable efforts to remove it within 7 business days.
8. Digital Gallery & Technical Failure
8.1 Where a digital gallery is included, images will be delivered within 10 business days of the Event Date and made available online for at least 90 days.
8.2 Partial failure. In the unlikely event of a partial technical failure (for example, the printer fails but digital images are still captured), we will provide a partial refund proportionate to the affected part of the Services.
8.3 Total loss. In the highly unlikely event that digital images are lost or corrupted due to equipment malfunction, our liability is limited to a refund of the amount paid for the affected service.
9. Events Beyond Our Control
9.1 We are not liable for delay or failure to perform caused by circumstances beyond our reasonable control, including severe weather, illness, power outages, fire, traffic, vehicle breakdown, venue access issues, pandemic or other force majeure events.
9.2 If we are unable to attend or deliver the Services, we will notify you and/or the Venue as soon as possible.
9.3 In such cases we will offer you, at your choice: (a) a full refund of all payments made, including the deposit; or (b) a transfer to a new date, subject to availability, at no additional cost. This is the limit of our liability in these circumstances.
10. Staff Meals, Travel & Breaks
10.1 Meals. A typical event requires our team to be onsite for around 7 hours including setup, pack-down and live coverage. A vendor meal is required for shifts of 5 hours or more. If a meal cannot be provided, please let us know in advance so alternative arrangements can be made.
10.2 Travel. Our base is Sydney. For events located more than 30km from the Sydney CBD, a travel fee may apply. Travel fees are calculated case-by-case and will be shown in your quote and confirmed before booking. We may reduce or waive the travel fee by agreement.
10.3 Rest breaks. Our attendants are engaged under the Amusements, Events and Recreation Services Award. Where the total shift (including bump-in and bump-out) is 5 hours or more, the attendant is entitled to a 20- minute paid rest break. This is typically taken during formalities or other quiet periods; the Booth may be placed in self-serve mode or, if leaving it unattended is unsafe, temporarily locked. Breaks do not extend the agreed Hire Period.
10.4 Formalities. The Booth may be temporarily paused or placed on a lock screen during formalities such as speeches, toasts or formal dances, at our discretion and as commonly preferred by MCs and event planners.
11. Complaints & Resolution
11.1 We want you to be happy with your experience. Both parties agree to act in good faith to resolve any concerns.
11.2 Any complaint regarding the Services must be made in writing by email within 7 days of the Event Date, to give us a fair opportunity to review and address it.
12. Governing Law
12.1 This agreement is governed by the laws of New South Wales, Australia, and the parties submit to the non- exclusive jurisdiction of the courts of that State.
13. Entire Agreement
13.1 These Terms represent the complete and exclusive agreement between Social Club Photobooth and the Client regarding the Services, and supersede any prior agreements or understandings, whether oral or written. Any amendment must be made in writing and agreed by both parties.
